If informal resolution is unsuccessful, the parties agree to attempt to resolve the dispute through non-binding mediation administered by a mutually agreed upon mediator in Burnaby, British Columbia, Canada, prior to initiating any formal legal proceedings. The costs of mediation shall be shared equally between the parties unless otherwise agreed.

11.3 Litigation

If mediation is unsuccessful or is waived by mutual agreement, either party may pursue their claims in a court of competent jurisdiction in the Province of British Columbia, Canada, in accordance with Section 10 (Governing Law) of these Terms. Nothing in this section shall prevent either party from seeking emergency injunctive or other equitable relief from a court of competent jurisdiction where necessary to prevent irreparable harm.

11.4 Waiver of Class Actions

To the extent permitted by applicable Canadian law, you agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action.
